Working Group Examining Forced Pooling Legislation

A working group has been meeting to develop a legislative proposal that would allow for forced pooling in West Virginia. The group, made up of representatives from the state’s natural gas industry and including attorneys with LGCR, is interested in developing a bill that could be considered during the 2011 regular session of the West Virginia Legislature. The legislation would address issues such as:
• creating a mechanism to develop the Marcellus Shale through horizontal drilling;
• properly compensating gas owners through regulatory recognition of "units" or "pools" of gas; and
• limiting the surface disturbance by the creation of these units.
